Notice on the Accreditation and Management of High-tech Enterprises in 2022 Release time: 2022-03-04Source: SCIENCE AND TECHNOLOGY COMMISSION OF SHANGHAI MUNICIPALITY

 

To all entities this may concern,

In 2022, Shanghai will carry out the accreditation and management of high-tech enterprises in accordance with the Methods for Accreditation and Management of High-tech Enterprises (Guo Ke Fa Huo [2016] No. 32, hereinafter referred to as the “Methods”), the Guidelines for the Accreditation and Management of High-tech Enterprises (Guo Ke Fa Huo [2016] No. 195, hereinafter referred to as the “Guidelines”), and the Implementing Measures for the Accreditation of High-tech Enterprises (Hu Ke He [2016] No. 22). The relevant work is arranged as follows:

I. Application duration:

In accordance with the Guidelines, applicants in Shanghai shall apply for the accreditation as high-tech enterprises between March 1 and September 20.

II. Application conditions:

Enterprises applying for the accreditation as high-tech enterprises shall meet the conditions set forth in Article 11 of the Methods for Accreditation and Management of High-tech Enterprises.

High-tech enterprises applying for a renaming on their certificate shall perform the renaming procedures as per the relevant requirements of the Guidelines.

Accredited high-tech enterprises relocating to Shanghai as a whole shall apply for new certificates within the validity period as per the relevant requirements of the Guidelines.

III. Application procedures:

(I) Accreditation of high-tech enterprises

The applicant shall register on the National High and New Technology Enterprise Accreditation and Management Network (http://www.innocom.gov.cn), submit materials online through the Government Online-Offline Shanghai (http://zwdt.sh.gov.cn), pass the formal review at the reception window and online expert review, and finally hand over paper materials after accreditation is announced.

1. Self-evaluation: Enterprises shall conduct self-evaluation according to the above accreditation conditions.

2. Registration: Enterprises that consider themselves as eligible for accreditation after self-evaluation shall carry out relevant work according to different situations:

2.1. Enterprises that have never registered after 2008 shall log on the National High and New Technology Enterprise Accreditation and Management Network (http://www.innocom.gov.cn), fill out the Enterprise Registration Form (Annex 1 of the Guidelines) as required, and submit it online.

2.2. Enterprises that have registered on the National High and New Technology Enterprise Accreditation and Management Network (http://www.innocom.gov.cn) after 2008 may directly file an application on Government Online-Offline Shanghai platform (http://zwdt.sh.gov.cn). In case of renaming within the validity period, the enterprise shall apply for renaming on the National High and New Technology Enterprise Accreditation and Management Network (http://www.innocom.gov.cn) and for a re-accreditation after the renaming application is accepted and relevant data synchronized by Shanghai Municipal Office for Accreditation of high-tech enterprises (for specific procedures, see 3.2 Application procedures for renaming of high-tech enterprises).

3. Online submission of materials: Enterprises applying for the accreditation as high-tech enterprises shall follow the procedures below: Log on the Government Online-Offline Shanghai (http://zwdt.sh.gov.cn) using USB Key (with up-to-date information), find “By Department” -> “Science and Technology Commission of Shanghai Municipality” -> “Accreditation of high-tech enterprises -> “Proceed Now” -> “Accreditation,” fill out the Application for Accreditation as High-tech Enterprises, and submit the following application materials online.

3.1. Application for Accreditation as High-tech Enterprises (submitted online, signed by the legal representative on the paper version, stamped with the official seal of the enterprise, and then color-scanned and uploaded to the Attachments - Other materials);

3.2 Intellectual property related materials

Intellectual property certificates (those regarding granted invention patents, utility models, designs, software copyrights, integrated circuit layout design and new plant variety can be directly identified by the application system without the enterprise uploading the certificates; relevant certificates or authorization notices and payment receipts must be uploaded for other intellectual property rights such as new drugs) and credentials proving the enterprise’s technical level, and the participation in the formulation of standards;

Proof of approval for research projects (acceptance or conclusion reports required for accepted or concluded projects);

R&D organization and management (overall situation and details on the compliance with four indicators) and other related materials;

3.3. Description of key technologies and technical indicators of high-tech products (services) offered by the enterprise, relevant production permit, accreditation, and qualification credentials, product quality inspection reports, etc.;

3.4. Special audit or verification report on R&D expenses of the enterprise for the recent three accounting years (or the actual operating period if the enterprise has existed for less than three years, same below) and income from high-tech products (services) in the past one accounting year issued by a qualified agency that meets the relevant conditions set forth in the Guidelines, together with descriptions of R&D activities, accounting of R&D expenses and auxiliary accounting report;

3.5. A financial and accounting report (including accounting statements and notes to accounting statements) of the enterprise for the past three accounting years certified by a qualified agency;

3.6 Annual tax forms of enterprise income tax in the past three accounting years (including main tables and schedules).

For classified enterprises, the application materials shall be decrypted to ensure the safety of classified information.

Enterprises shall engage an accounting firm or a tax agency for special audit on R&D expenses and income from high-tech products (and services) in strict accordance with the following standards (for relevant information, please refer to the public information of the trade association). Such agencies shall:

(1) Be qualified for independent practice; have been established for more than three years without any bad records in the past three years.

(2) Have certified accountants or tax accountants who account for no less than 30% of the total number of the monthly average workforce (more than 20 incumbent employees) in the year of accreditation.

(3) Be equipped with personnel who have good professional ethics, understand the national S&T, economic and industrial policies, and are familiar with the relevant requirements for the accreditation of high-tech enterprises.

An accounting firm or tax agency that meet these conditions and issues a special audit report for an enterprise in Shanghai shall, at the time of submitting the special audit report, also submit relevant certifications of itself, including business license (photocopy), practicing certificate (photocopy), the average number of monthly employees in current year, and the number of certified public accountants. It shall also provide the auditor certificate number and other information in the attached table of the application for accreditation.

4. Acceptance and review

Materials submitted online by the applicants shall be accepted at the reception windows (see Annex 1 for contact information). Once the materials are reviewed and confirmed as complete and true, the online reception is finished; and after receipt of application materials, the review organization shall classify them by technical field, and organize online expert review.

5. Reporting

After the expert review, the review organization of high-tech enterprises shall conduct a comprehensive review of the application materials in reference to the opinions of the expert panel (field verification of some enterprises may be carried out as appropriate), and put forward preliminary review opinions.

The review opinions shall be reported by the review organization of high-tech enterprises to Shanghai Municipal Office for Accreditation of High-tech Enterprises. Applicant organizations that meet the accreditation conditions shall be announced after being approved by the Shanghai Steering Group for Accreditation of High-tech Enterprises, and officially reported to the Office of the National Leading Group for Accreditation of High-tech Enterprises.

6. Announcement

The list of enterprises that have been accredited shall be announced in SHST and the National High and New Technology Enterprise Accreditation and Management Network for ten working days. Where there is no objection to the announcement, the list shall be published by the Shanghai Steering Group for Accreditation of High-tech Enterprises after being filed and approved by the Office of the National Leading Group for Accreditation of High-tech Enterprises, and the standardized Certificate of High-tech Enterprise (stamped with the seals of the STCSM, the SMFB, and Shanghai Municipal Tax Service) shall be issued to accredited enterprises. The time of accreditation announced in the national notice shall prevail, and the list of accredited enterprises shall be announced on the website of the Science and Technology Network of Shanghai Municipality and the National High and New Technology Enterprise Accreditation and Management Network.

Where there is any objection to the announcement, an application for reexamination shall be filed to the review organization, which will then, along with Shanghai Municipal Office for Accreditation of High-tech Enterprises, organize the verification and reexamination.

7. Offline submission of paper materials

The Application for Accreditation as High-tech Enterprises and related attachments shall be bound up into a complete set of paper application materials (electronic edition and paper edition are identical), and submitted to the reception window within ten days after the announcement.

8. Ongoing and ex-post supervision

Shanghai Municipal Office for Accreditation of High-tech Enterprises shall, in accordance with the Methods, carry out random spot checks and special inspections on high-tech enterprises at a certain ratio in conjunction with the review organization.

(II) Application procedures for renaming of high-tech enterprises:

Enterprises shall log on the National High and New Technology Enterprise Accreditation and Management Network (http://www.innocom.gov.cn) to file a renaming application. An enterprise that applies for renaming only, has no major change and meets the conditions for accreditation as high-tech enterprise shall be issued a renewed certificate, with the serial number and valid period unchanged, by Shanghai Municipal Office for Accreditation of High-tech Enterprises after the renaming is announced for ten working days on Science and Technology Network of Shanghai Municipality without receiving any objection.

(III) Application procedures for relocation of high-tech enterprises:

1. Application of accredited high-tech enterprises for relocation to Shanghai

After receiving the business license issued by Shanghai Municipal Administration for Market Regulation, high-tech enterprises relocating to Shanghai shall log on the National High and New Technology Enterprise Accreditation and Management Network (http://www.innococom.gov.cn) to submit the valid Certificate of High-tech Enterprise and relevant documents issued by local registration and administration authorities such as Shanghai Municipal Administration for Market Regulation. Those completing the relocation shall be issued a new certificate by Shanghai Municipal Office for Accreditation of High-tech Enterprises, with their qualifications and certificates remaining valid (serial number and validity period unchanged). Their latest status shall be announced on the National High and New Technology Enterprise Accreditation and Management Network.

2. Application of accredited high-tech enterprises in Shanghai for cross-district relocation

An enterprise shall file an application for cross-district relocation in the application system (https://kjgl.stcsm.sh.gov.cn/stcsm/userLogin.jsp) with explanations for the reason of relocation, and upload PDF documents to prove that its tax affairs have been transferred to the destination district. Upon review and approval by the reception window of the recipient district (park), the relocation is completed. Virtually registered enterprises are not encouraged to relocate in order to obtain subsidies.

III. Others

In order to effectively manage the accreditation of high-tech enterprises in 2022, Shanghai Municipal Office for Accreditation of High-tech Enterprises will launch campaigns of policy promotion and training. The Office, the science and technology commissions of various districts, and the sub-parks in Shanghai High and New Technological Development Zone will all arrange training sessions. Relevant entities shall pay close attention to them.

Shanghai Municipal Office for Accreditation of High-tech Enterprises has never entrusted any organization or individual to act as an agent for the accreditation of high-tech enterprises. Applicant organizations shall apply by themselves. Shanghai Municipal Office for Accreditation of High-tech Enterprises will accept applications in strict accordance with relevant standards and procedures without charging any fees. In case that any organization or individual collects fees from enterprises in the name of the Office or its staff, please notify us immediately. Enterprises may consult any reception window (see Annex 1 for contact information) if they have any question in the process of application.
